CDM 2024: who is the PCWD and what must the client appoint?

This post explains who the Principal Construction Work Designer (PCWD) is under Malaysia's CDM 2024 regulations, who must appoint them in writing, and the personal liability a client faces for failing to. It also covers where AI-based safety monitoring on existing CCTV can support evidence of construction-phase controls, without replacing the legal appointment duties themselves.

CDM 2024: who is the PCWD and what must the client appoint?

A PCWD is the Principal Construction Work Designer — the professional the Malaysian Occupational Safety and Health (Construction Work) (Design and Management) Regulations 2024 put in charge of managing safety risk through the design and pre-construction phase. The client must appoint that PCWD in writing, early, before the design the PCWD exists to manage is underway and before the construction phase begins — and a client who does not inherits the role's duties personally, with exposure up to RM500,000 in fines and/or one year's imprisonment.

That penalty is the hidden cost almost everyone underestimates. It does not sit with the contractor on site; it sits with the client who skipped a written appointment at project inception. CDM 2024, in force since 1 June 2024, moved accountability upstream to whoever commissions the work, and the cheapest control in the whole regime is a signature made before design starts.

What the PCWD actually does

The PCWD is appointed by the client to plan, manage and monitor the pre-construction phase. In practice that means:

  • Coordinating safety across all designers so risk is designed out, not discovered on site.
  • Applying the general principles of prevention and design risk management to eliminate or reduce foreseeable risks at the design stage.
  • Preparing and maintaining the Safety and Health File (SHF) that carries risk information forward to construction and beyond.

To hold the role, the appointed party must be an Engineering Consultancy Practice with the required skill, knowledge, experience and capability, and the responsible Professional Engineer must hold a Practising Certificate. It is a competence-gated appointment, not a title handed to whoever is available.

Who appoints whom, and when

Duty holder Appointed by When If not appointed
Principal Construction Work Designer (PCWD) Client, in writing At project inception, before the design phase Client inherits the PCWD duties and liability
Principal Construction Work Contractor (PCWC) Client, in writing Before the construction phase begins Client inherits the PCWC duties and liability

The structural point: the client makes two written appointments, and the "in writing, before the phase begins" wording is doing the real work. A verbal understanding, or an appointment made after design decisions are already locked, does not discharge the duty — and the default on non-appointment is not a gap, it is the client personally carrying the role.

The hidden-cost reading for clients

Developers and asset owners read CDM 2024 as a contractor problem because contractors are the visible presence on site. The regulation is built the other way around. DOSH does not expect the client to manage the construction work hands-on, but it does require the client to make suitable arrangements — the written appointments, the pre-construction information to designers and contractors, and assurance that a construction phase plan exists — so that safety is secured from inception.

Miss the PCWD appointment and the cost is not a line item you can negotiate later; it is strict personal exposure of up to RM500,000 and/or a year, plus the practical reality that you are now doing a specialist job you are not qualified for. The design-stage decisions that a PCWD would have de-risked become your liability. Appointing in writing, early, is the control that removes that exposure, and it costs a professional fee and a signature.

Where Hypernology fits, honestly

This page is a regulatory explainer, not a product claim — the duties above are the law, not a Hypernology capability. Where the connection is real: once the construction phase begins, demonstrating that the construction phase plan is being followed is an evidence problem, and a context-aware safety layer that runs on existing site CCTV can record whether named controls — exclusion zones, work-at-height discipline, permit conditions — were observed. That supports the duty holders' record-keeping; it does not replace the PCWD, the PCWC, or the client's appointment obligations, which are legal roles no camera discharges.

Frequently asked questions

What does PCWD stand for? Principal Construction Work Designer — the role under Malaysia's OSH (Construction Work) (Design and Management) Regulations 2024 responsible for managing safety risk through the design and pre-construction phase, appointed by the client.

Who must appoint the PCWD, and when? The client, in writing, at project inception before the design phase and before construction begins. A client who fails to appoint one inherits the PCWD duties and personal liability.

What is the penalty for not appointing a PCWD? The client becomes personally liable for the role's duties and faces penalties up to RM500,000 in fines and/or one year's imprisonment for non-compliance, enforced by DOSH.

If you are a developer or asset owner unsure whether your appointments are correctly made, speak to a qualified CDM adviser before design starts — and if you need to evidence construction-phase safety controls on your existing site cameras, start at https://apac.hypernology.net/contact.
